Hilton’s publicist, Elliot Mintz, says she was exiting the parking garage which “is brightly lit so she had not noticed that her headlights were not activated.” As she drove a few blocks, she was stopped by the police. Deputies say that Hilton was speeding down Sunset Blvd. without headlights. She was pulled over and deputies discovered she was driving with a suspended license. She was given a ticket for driving on a suspended license but later released. Mintz says, “When she called me, she asked if her license was suspended. If that’s the case, she and I are unaware of it.” Hilton’s 2007 Bentley Continental GTC Convertible was impounded and towed away. Hilton violated the terms of her probation when she was arrested for driving on a suspended license, and could spend up to 90 days in jail as a result. She was arrested on September 7th for DUI in Hollywood. In January, she pleaded no contest to alcohol-related reckless driving. She was sentenced to 36 months’ probation, alcohol education and $1,500 in related fines. As a result, the DMV also suspended her license, and a judge placed her on 36 months probation, with one major condition being: to “obey all laws.”

A Florida court of appeals will hear the case as to where Anna Nicole Smith’s body is to be buried, with oral arguments to be presented Wednesday morning. At 9:30 AM, Justices Barry Stone, Mark Polen and George Shahood of the Fourth District Court of Appeals will hear 20 minutes of arguments from lawyers for Virgie Arthur, who is seeking to bury Anna’s body in Texas, and 10 minutes each from attorneys for Howard K. Stern and Larry Birkhead, both of whom are seeking to have Smith’s remains buried in the Bahamas. Richard Milstein has also filed his appeal asking the court to uphold Judge Seidlin’s ruling give him custody of Smith’s body on behalf of her baby daughter.

A $250,000 assault case against country singer Hank Williams Jr. has been dismissed due to a lack of evidence. Williams was accused of verbally abusing and choking waitress Holly Hornbeak at a hotel in Memphis, Tennessee, last March. Hornbeak told the jury how Williams allegedly grabbed her around the throat and shouted obscenities at her, leaving red marks and bruises on her neck. Trustees for James Brown filed a motion asking a judge to allow DNA samples to be taken from his body to prove the paternity of anyone claiming to be one of his children. “Since Brown died two months ago, several people have come forward claiming he is their father,” said one of the trustees, Buddy Dallas, who would not specify how many claims have been made. Brown named six adult children in his will, and his partner, Tomi Rae Hynie, has said her young son also is Brown’s child. Brown’s body remained in a gold coffin at an undisclosed location, according to the funeral home that handled Brown’s arrangements. The DNA would need to be taken as soon as possible because Hynie has agreed with Brown’s children on burial plans, a lawyer for Brown’s trustees said. After the body is buried, getting DNA will involve more legal efforts. When and where Brown will be buried have not been made public.

A Florida appeals court issued a stay in the dispute over Anna Nicole Smith’s body, ruling that her remains cannot be moved to the Bahamas until the court hears a challenge from her estranged mother, Virgie Arthur. Arthur had filed a motion with Judge Larry Seidlin, asking him to reconsider Friday’s ruling which paved the way for Smith to be buried in the Bahamas. Judge Seidlin denied that request. Arthur then filed an appeal with the 4th Circuit Court of Appeals, which has now agreed to hear the challenge to Seidlin’s ruling.

For the second time in a year, Bobby Brown has been arrested while in town to watch his daughter at a cheerleading competition. Brown was picked up at his daughter’s high school on a warrant for failing to appear at a child support hearing in October.”He was scheduled to appear in Norfolk Probate and Family Court,” said Adam Loomis of All State Constables.”He was supposed to show up and prove everything was up-to-date,” Loomis said. In October, Brown paid $11,000 in delinquent child support after being threatened with arrest if he stepped back into Massachusetts. He owed over two months of payments to Kim Ward, the mother of two of his two children. “Brown was cooperative outside the high school, and borrowed a cell phone to arrange to get out of jail,” the constable said. In June 2004, Brown was sentenced to 90 days in prison for missing three months of payments. That sentence was immediately suspended after Brown paid about $15,000. Last March, Brown was arrested for minor motor vehicle violations dating back 14 years when he arrived to watch his daughter at a cheering competitionl. “Brown was cooperative, and he was allowed to drive to the police station after the competition,” police said.

The judge who ruled on who gets control of Anna Nicole Smith’s body wants her buried, and will not let her mother, Virgie Arthur stand in his way. The appeal filed by Smith’s mother, just moments after Circuit Judge Larry Seidlin’s teary decision to release Smith’s body to her daughter’s court-appointed guardian Thursday, was rejected early Monday morning, saying he wanted to preserve Smith’s dignity by having the funeral occur as quickly as possible. In the court papers, Seidlin claims that a stay would increase the “potential for adverse consequences,” adding that “Arthur seeks an indefinite stay and has shown no intent to expedite the proceedings.” Lawyers for Smith’s mother want the 4th District Court of Appeal to reconsider Judge Seidlin’s ruling. Arthur wants Smith buried in Texas. In the court filing, Arthur’s lawyer, Roberta G. Mandel, said the ruling was an inconvenience because the mother “will have to have a passport and roundtrip airplane tickets and several thousand dollars to even visit or put flowers on Smith’s grave.” Outside court, Mandel said Arthur was willing to take the fight to the state Supreme Court, if necessary.”This mother is a mother who deserves the right to bury her child,” Mandel said. “The trial court treated her as though she was nothing.” Smith’s boyfriend, Howard K. Stern, testified last week that Smith wanted to be buried in the Bahamas.
