Jennifer Lopez has been ordered to testify in response to a lawsuit which claims she stole the idea for her TV show ‘South Beach.’ Writer Jack Bunick filed a lawsuit last year alleging the idea for the now-cancelled series, which first aired in January 2006, was modeled on a 1999 pilot episode for his show ‘South Beach Miami.’ Judge Henry Pitman has ordered executive producer Lopez, who was one of six defendants named in Bunick’s claim along with the UPN and CBS Television Networks, to provide her sworn testimony in the case. Lopez’s lawyer, Orin Snyder claims Bunick sued “for tactical reasons, in an apparent attempt to obtain some perceived leverage by targeting and harassing her in a case where she has no meaningful testimony to give and no legitimate reason for being named as a defendant in the first place.” Snyder argued that Lopez was not heavily involved in the creation and development of ‘South Beach.’ He added: “She was brought in at a later stage to lend celebrity to the show.” Bunick is seeking unspecified damages and an injunction banning any future broadcasts of ‘South Beach,’ which was canceled in February 2006 after only eight episodes. The show focused on Miami’s modeling and nightclub scene.

A lawsuit brought against Paul McCartney by a German woman alleging he manipulated the results of a paternity test has been dropped. Bettina Hubers claimed the former Beatle was her biological father following an affair with her mother Erica while the band was playing in Hamburg, Germany in the early 1960s.McCartney had denied paternity, claiming to have taken a DNA test proving so in 1983, but Hubers accused McCartney of “faking” the test by sending a body double to give a blood sample. However the prosecution announced any examination of the documents from the paternity test 24 years ago would not proceed as it would be illegal. They released a statement, “The alleged offense, even if it had taken place, would be statute-barred today. The unenforceability of the statute of limitations is opposed to further investigations.”

Ryan O’Neal will not face criminal prosecution for allegedly firing a gun during a late-night brawl with his son Griffin in February. The Los Angeles County District Attorney claims there was “insufficient evidence to prove the case” against O’Neal, even after police interviewed and re-interviewed several witnesses. Ryan was arrested and booked on charges of assault with a deadly weapon and negligent discharge of a firearm after Griffin’s girlfriend called 911. In February, O’Neal’s attorney Mark Werksman claimed that Ryan was badly injured in the incident, after Griffin allegedly struck him with a fire poker. Ryan’s lawyer also stated that he “fired a shot in warning, not in anger.” Ryan’s representative, Neil Hassman, says, “We’re extremely happy that the D.A., after a thorough investigation, has come to learn what we’ve known all along. Tom Sizemore pleaded not guilty to felony drug charges in Kern County Superior Court, authorities said. He is now in danger of having his felony probation revoked from a previous drug bust, which could result in a lot of prison time. “Sizemore was arrested May 8 after police found two bags of suspected methamphetamine and smoking pipes in his car parked outside a hotel in Bakersfield,”police said. At the time, Sizemore, who was still on probation for a previous drug conviction, faces seven drug-related charges, including transportation and possession of methamphetamines, possession of prescription drugs without the proper prescription and being under the influence of a controlled substance. He also faces a vandalism charge. “He faces up to 6 years in prison if convicted of all the new charges,” said prosecutor Cynthia Zimmer of the Kern County District Attorney’s Office.Now the Los Angeles District Attorney’s office confirms they will ask a judge to revoke Sizemore’s probation on the previous conviction, which was ordered after he pleaded guilty to possession of narcotics in 2006. They will also request that Sizemore spend 16 months in a state prison as a result. One of the terms of Sizemore’s probation was to stay out of trouble. At the June 5 hearing, a judge may decide if his arrest violated that term.

The judge in Phil Spector’s murder trial ruled that renowned forensic expert Henry Lee removed a tiny, but potentially important piece of evidence from the shooting scene and hid it from the prosecution. After convening a special six-day hearing into accusations of evidence-tampering, Superior Court Judge Larry Fidler declined to hold Lee in contempt of court. Fidler said that if the criminologist testifies for the defense, prosecutors can raise the issue of the missing evidence before jurors. Former Spector lawyer Sara Caplan and private investigator Stan White testified during the hearing that Lee recovered a small white object from the producer’s foyer. The prosecution contends the item was a piece of fingernail with the trace of a passing bullet that would show Clarkson was resisting having a gun placed in her mouth. Her right thumb was missing a piece of acrylic fingernail after her death. Lee denied taking anything from the scene, but the judge said Caplan’s testimony was more credible.”If I have to chose between the two, I am going to choose Ms. Caplan as more credible than Dr. Lee,” Fidler said. “Dr. Lee has a lot to lose if this turns out to be true.”
